By accessing or using Influence500 (the "Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Service. These terms are governed by the laws of New South Wales, Australia.
2. Service Description
Influence500 aggregates and presents publicly available data from Australian government lobbying registries. We make no representations or warranties about the accuracy, completeness, or timeliness of this data.
3. No Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY AUSTRALIAN LAW, INFLUENCE500 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED AUSTRALIAN DOLLARS (AUD $100), WHICHEVER IS LESS.
5. Data Accuracy
All data displayed on Influence500 is sourced from publicly available government registries. We do not verify, validate, or guarantee the accuracy of this data. Users should independently verify any information before relying on it for business decisions.
6. Third-Party Data
Rankings, client lists, and revenue figures are derived from government sources. We are not responsible for errors, omissions, or inaccuracies in the underlying government data.
7. User Conduct
You agree not to: (a) scrape, harvest, or collect data from the Service using automated means; (b) interfere with or disrupt the Service; (c) attempt to gain unauthorized access to the Service; or (d) use the Service for any unlawful purpose.
8. Subscriptions and Payments
Subscription fees are non-refundable except as required by Australian Consumer Law. We reserve the right to change pricing at any time. Continued use of the Service after price changes constitutes acceptance of the new pricing.
9. Termination
We may terminate or suspend your access to the Service at any time, for any reason, without notice or liability. Upon termination, your right to use the Service will immediately cease.
10. Indemnification
You agree to indemnify and hold harmless Influence500 and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
11. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Competition and Consumer Act 2010 (Cth) or other applicable Australian consumer protection laws.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of the modified Terms.
